Attorney Kenneth Kirk practices mainly in the areas of estate planning (the use of wills, trusts, and other devices to facilitate smooth transfer and handling of someone’s assets when they die or become incapacitated), Medicaid planning (making people eligible for various public benefits if they do not qualify because of excessive income or assets), and adoptions (representing prospective adoptive parents). He has also occasionally practiced in the following areas:

 
Family Law

While he has a few ongoing cases in this area, Mr. Kirk is not accepting any divorce, custody, child support, or related matters. The sole exception is adoptions, which he continues to handle.

 
Probate:

Mr. Kirk is only accepting probate cases for current or previous clients. If he has done the estate planning, Mr. Kirk will be happy to assist with the probate. However in order to avoid becoming overloaded, he is not accepting probate cases for new clients.

 
Guardianship:

Mr. Kirk no longer handles minor guardianships. He handles adult guardianship and conservatorship cases only for ongoing clients.

 
Prenuptial Agreements

When an engaged couple wants a prenuptial agreement, one of them hires an attorney who drafts the initial agreement, and then the other hires an attorney to review the agreement on his or her behalf, and then the two attorneys and the two fiancés negotiate to a final agreement. At present, because of the shortage of lawyers in Alaska with experience in the various areas of law involved in prenuptial agreements, Mr. Kirk is willing to serve as the attorney who reviews and negotiates, if another attorney has completed the initial draft. He does not serve as the initial drafting attorney.

 
Constitutional Law

Kenneth Kirk has handled constitutional cases in the past, particularly in the areas of First Amendment rights, and sanctity of life issues. However in early 2011 he was appointed to the Alaska Public Offices Commission, and because this is a politically sensitive position, and constitutional cases are often politically controversial, he has chosen not to accept any constitutional cases for the duration of his appointment in order to avoid conflicts.
