Considering Adoption

Adoption is a wonderful way to provide love to a child, both for the prospective parents who adopt the child, and for the birth mother who makes the difficult decision to offer her child a better life through adoption.  Kenneth Kirk does everything possible to guide people smoothly through the legal process to facilitate this loving act.


If you are thinking of adopting, even if you are not completely sure or have not yet located a child to adopt, you should come in for a free initial consultation. This is an opportunity to find out about the process and the legalities, so that if you eventually do connect with a child to adopt, you will be ready, and you can also beware of certain situations you may decide you want to avoid.

 
Adoption Cases and Type

Many adoption attorneys will not handle cases which involve ICWA (the Indian Child Welfare Act), a federal law which applies whenever the child in question has a certain amount of American Indian, Eskimo, or Aleut ancestry.  Some attorneys will not handle cases which fall under the ICPC (Interstate Compact on Placement of Children) which usually applies to adoptions across state lines.  Mr. Kirk handles both of these types of adoptions, despite the complexities those laws add to the case.  He also handles contested adoptions when necessary.


Most of the adoptions Mr. Kirk handles are private adoptions; that is, a birth mother has made her own arrangements with an individual or couple to adopt her child. Those are usually done on a flat fee basis, which the attorney can quote you once he has enough information about the anticipated adoption. Mr. Kirk also handles OCS (Office of Children’s Services) adoptions in which the child protective agency reimburses the adoptive parents for their attorneys fees. In those cases Mr. Kirk works on an hourly rate, and gets paid from the reimbursement at the end.
